Railway workers should know about the Federal Employers' Liability Act (FELA). This is legislation that takes care of railway workers that are injured while working. It is important to know that this act exists but not necessary to understand all that it encompasses. It is a quite complicated set of rules that FELA attorneys understand inside and out.
Even if you are not injured, it is good to be aware of what types of injuries occur on the railway. The responsibility of a railway worker can include heavy machinery. It will be better to be evaluated from a doctor that has no relationship with your employer. While under medical treatment or after treatment, request to receive a copy of your medical records. This includes medical records from treatment you received immediately after you were injured.
Make sure that you file an employer incident report. After you have been injured, you should obtain this form to complete from your supervisor. Be specific in your report and include all facts you think may have caused your incident. This incident report may help your FELA claim.
When you meet with your FELA attorney, come prepared. Take some time before your appointment to document what details you remember about the incident. Document every detail you can remember including what you were doing, what shift you were on, who else was working with you and what witnesses were present. Only your attorney will know what details are irrelevant, so include every detail you can. Include in your personal report how you feel now and how the injury has affected your life and anyone around you.
